The REJIM TRANSPORT VTC company provides transport services by means of Transport Vehicles with Driver (VTC), exclusively on reservation and at a pre-defined price. The head office of REJIM TRANSPORT VTC is located at 13 rue Jules Froment, 69008 Lyon.

www.magic-vtc.fr is a commercial entity supervised by the company “Rejim Transport vtc. ”

1. OBJECT

The purpose of these General Terms and Conditions is to define the conditions applicable to transport service contracts concluded between www.magic-vtc.fr and its customers. By using the services of www.magic-vtc.fr, the Customer is presumed to have read these General Terms and Conditions of Sale and to have them fully accepted. This sales contract is a contract with commitment.

The booking entails a firm commitment from the seller and the buyer regarding: – the obligation to buy for the consumer;
– and that of providing the goods, or the provision of services for the merchant.

In principle, there is no possibility of a withdrawal for the customer. 2 – FORMATION OF THE CONTRACT FOR THE PROVISION OF TRANSPORT

The customer provides all the information concerning his request for service. He is solely responsible for this information, the following of which are considered essential to the contract: date of the transport

service, place of pick-up, drop off point, pick-up time, number of passengers (adult / child), number luggage (s), nature of the service (transfer, availability). www.magic- vtc.fr fixes the price of the service based in particular on the information provided by the Customer.

The price is paid by credit card via a secure electronic system. By providing his bank details, the customer agrees in advance and without condition that www.magic-vtc.fr proceeds to the secure transaction and authorizes in advance his bank to debit his account the amount of the benefit. After confirmation by the Customer of his request for service and payment of the price, www.magic-vtc.fr sends him, in return, by mail only, a booking form summarizing the information related to the service. The customer is responsible for checking the information in the booking form. If it is impossible for www.magic-vtc.fr to send by email the booking form, the reservation is presumed to comply with the customerʼs request.

3 – RATES

www.magic-vtc.fr fixes the price of the service based in particular on the information provided by the Customer. The prices indicated in our tariffs include the VAT at the rate fixed by the regulations in force for the services of transport (10% for the transfers, 20% for the layouts), the service chauffeur, the fuel and the unlimited insurance of the persons transported, tolls are included in the transport.

Fees required by the terms of the GTC: deterioration of the vehicle, parking fees, waiting fees, travel expenses, dynamic pricing, night fare, approach fare, empty return, regulation fresh vehicle range, booking fees, pet fee and valet or concierge service.

Code of calculation for the deposit: estimation rate of the transfer to the package and non-fixed (for payment on board) or estimation rate fixed price and non fixed approach or return to empty of the transfer + (or not) 50% of the booking fees of the price of this tariff = the amount of the deposit that can be cased as a result of the various fees payable. Details of the fees payable:

The total price and TFC (all expenses included) of the race will not really be noticed until after the service provided. However, if the customer does not reserve within the given time (24h before) the horokilometrique

The business class will be at the same price as the NPV. Vehicle model type “Mercedes- Benz E-Class” So if there is a lack of eco vehicle a business class vehicle will be sent to you for your support and will add additional costs. On your first purchase orders will be registered only the price inclusive of a transfer whether it is in Go or Back but never the price of the fees that are added in addition.. The costs of reservations, late arrival, circulation, the approach tariff, the empty return tariff, dynamic pricing or night will be punctured on board the vehicle or by direct debit because any type of reservation whether it is already paid or not will be the object of a bank impression to prevent any act of grivellation including “no show”, the levy will be justified by email with a global invoice including the booking fees and dynamic pricing or with a second order form expressing the total cost of your tariff. Parking fees are not included in the service.

4 – REGULATION

You hereby authorize REJIM TRANSPORT VTC and the platform WWW.MAGIC- VTC.FR to submit your payments by all means of payment: Accepted methods of payment: Cash, bank transfer, checks, credit cards (Visa, MasterCard , Amex etc. in VADS or VAD). Any transport service by transfer or provision is payable to the order. Remote payment over the phone by providing us; copy of identity card, bank card and settlement notice completed and signed.

By accepting the general conditions of sale, the customer authorizes the use of his credit card as well as the safeguarding of his data for the remote settlements and for other potential reservations as for all the expenses which will be added after the benefit and once recognition thereof to an indefinite limit. The customer hereby accepts the safeguarding of all his personal information for potential commercial steps.

Payment on board: As in all shops, when you book any service the merchant will always ask you for a guarantee. In this case it is the rental car with driver with a facility of “payment on board. So it goes without saying that the company requires a guarantee that will allow you in addition to that to ensure you a driver. Payment on board is considered as a commercial gesture and postpones the payment of the outward journey to the performance of the service. If the customer wishes to cancel the race, the latter must be liable for the full price of the race.

For payments on board a guarantee will be required, it is a bank guarantee in the form of pledge which will guarantee the capacity of a customer to pay the costs in

case of deterioration of the vehicle, detours, expenses of increase related to the circulation or the delay of the customer or in case of cancellation.

A deposit will be levied in case of breach of the commitments of the customer as mentioned above, therefore a bank impression will be made to the amount of the sum due by the customer registered on the first purchase order or the final order form. REJIM TRANSPORT VTC reserves the right to charge a sum in addition for damages for compensation. This sum is fixed by the company REJIM TRANSPORT VTC. But the banking imprint made upstream is only a deposit pledge to guarantee you a driver for your care.

In case of late payment:

Every 45 days the bill will be increased by 4.16% as provided in Art L 441-6 of the Commercial Code. And this out of bailiffs management fee and lawyer fees, disbursements and costs.

Professionnels : The interest rate provided for in the General Terms and Conditions generally corresponds to the European Central Bank (ECB) semi-annual management rate (refinancing rate or Refi), in force on 1 January or 1 July, plus 10 points.

Example: 10.00% (0.00 + 10) for penalties due since July 1, 2019.

5 – RESERVATION AND CANCELLATION 5 – 1 – RESERVATION:

Any reservation implies the unconditional acceptance of these general conditions of sale. The client and the provider undertake to respect all the clauses mentioned in this contract. No modification may be made to the conditions above unless prior agreement between the parties. This contract is suspended by the platform www.magic-vtc.fr, the charges may be offset or canceled by right and without compensation (including including the reimbursement of the race) of any kind in all cases recognized force majeure (external event at www.magic-vtc.fr) such as disruption of traffic lanes, bad weather, manifestation, accident, breakdown or malfunction of telecommunication networks, shortage of manpower or material … The contract is deemed concluded only after the order is placed through the various communication tools delivered by the platform www.magic-vtc.fr; website, application, phone +33 7 69 14 29 28 / + 33 4 69 96 49 00 or by email: contact@magic-vtc.fr. Any booking of a car with driver is mandatory and must be made at least 24 hours in advance by the website or the other means of communication mentioned above, at

the last minute by phone depending on availability; in this case the driver reserves the right to set the amount of the pricing according to the VTC law in force.

Particularity for a pickup in train station and airport: Upon arrival, turn on your mobile phone.

The driver reserves the right to shift his assumption of responsibility in the manner specified above.

Please note in “further information” when booking the flight or train number.

For flights, if you do not have baggage checked in the hold, the 15 minutes of waiting included in the race are usually sufficient. However, if you have to collect checked baggage and / or if you come from a non-European destination, the time of exit of the plane, the recovery of the luggage and the eventual control of the forces of the order require rather important delays .

To avoid having to pay a wait, we advise you to add a delay of 30 minutes.

A beat of 30 minutes is granted to the driver from the time of taking charge of the purchase order.

The rate of late payment for an individual is 4.16% after 45 days after the date of arrival on your voucher corresponding to the invoice issued. Rejim transport VTC reserves the right to increase by three this rate compared to the legal rate. Any return trip and paid in advance as a deposit and cash.

The delay rate for professionals is set freely by the provider in accordance with the law.

guarantee the ability of a customer to pay the costs in case of damage to the vehicle, detours, surcharges related to traffic or delay of the customer or in case of cancellation.

5 – 2 – CANCELLATION:

Any amount advanced by the customer by cash, check, credit card or online payment is considered a down payment. If the customer refuses to complete the booking or registration and decides to cancel the race the sum will be lost in full under Articles L21 4-1 to L214-4 of the Consumer Code.

If a customer orders and the platform can not honor a race in a force majeure, www.magic-vtc.fr may under a commercial gesture offer the refund of the race in the form of credit. The platform does not reimburse any amount advanced in the form of liquidity.

Payment on board is considered as a commercial gesture and postpones the payment of the outward journey to the performance of the service. If the customer wishes to cancel the race, the latter must be liable for the full price of the race.

In case the customer refuses to pay his invoice or order: the platform reserves the right to cash the amount of the deposit which will be equivalent to the amount of the race price as well as additional fees and allowances. The compensation will be up to 50 to 100% of the price of the fine that the law provides in case of grivèlerie, 7000 € under Article 313-5 of the Penal Code.

Any amount paid in advance on the site magic-vtc.fr or directly to an agent or the manager, will be considered as a deposit regardless of the means of payment used.

Articles L214-1 to L214-4 of the Consumer Code which states that:

The deposit is an amount paid in advance by a customer during a purchase. The deposit entails a firm commitment from the seller and the buyer concerning:

– the obligation to buy for the consumer;
– and that of providing the merchandise for the merchant or the provision of service;

In principle, there is no possibility of a deduction, neither for you nor for the trader. Consequence: If you refuse to execute the contract, you lose not only the down payment, but in addition the merchant may demand the execution of the contract and claim damages in case of default.

Not settling a simple order is punishable by law. The grouse is forbidden in France.

The term used in the French penal code is “filouterie”. Under Article 313-5 of the Penal Code.

It is an act of ordering a service that you will not pay, or that you know you will not be able to afford.

The offense is constituted if:

the service has been ordered by the client;
the service was consumed (meal started or finished, room occupied, taxi ride performed, fuel tank filled, etc.);
the client is physically unable to pay his debt or is determined before consuming not to pay;
the fraudulent intent is recognized (this fraudulent intent must be prior to consumption, the offense is not necessarily constituted, for example, if the consumer forgets to pay because busy on the phone, or suddenly because of a sudden event force majeure or even because it would be disturbed by smoke or noise).
In common parlance, we speak of fraud for serious acts, and of free-flight for acts of lesser gravity.

Examples of filouterie:

to leave a restaurant, a bar, a hotel after being served, without paying the bill or note; get fuel and leave without paying.
take the taxi and leave without paying the price of the race.
Examples of racks:

take the train without a ticket (alternative: travel first class with a second class ticket);
not paying the toll;
not to pay for parking, parking;

Penalty in French law
The filouterie is punished by a sentence of six months imprisonment and a fine of € 7,500 and possibly by a complementary penalty (for example: ban on issuing checks) or substitution (for example: community service work ).

This penalty can be compared to those for acts of free riding, generally sanctioned by a contravenal fine (less than 1 500 euros).

5 – 3 – PRICE INCREASE / DELAY / CAP / CIRCULATION

Any delay of the passenger (s), or any expectation exceeding the time of the package indicated on our simulation or any deviation in addition to Km indicated on our simulator or in relation to the schedule of care indicated in the booking voucher entails an increase in the price of the service, in particular if the customer informs the driver by telephone on 07 69 14 29 28 for the delays as follows:

More than 15 minutes late : 10 euros

More than 30 minutes late: 25 euros
For every half-hour extra delay: 25 euros
This amounts to 0.83 cents per minute, these prices are also valid for heavy traffic or traffic jams or any type of deviation due to unforeseen events such as the disruption of traffic lanes (work, etc.), weather, events, accidents, breakdown or malfunction of telecommunication networks

The payment of these surcharges occurs at the latest at the time of the rise of the passenger (s) in the vehicle. Or at the end of the race.

In case of absence of the customer at the place of appointment, beyond the first 15 minutes free, without any demonstration on his part, or response to the phone call of the driver, the service will be permanently lost, without possibility of report and without being able to claim any refund.

6 – QUALITY OF SERVICE

The transport of persons for a fee is a regulated activity. Only authorized vehicles can perform this service and:

Provided with a professional card number issued by the prefecture.
Equipped with a certificate of registration issued by the Ministry of Ecology, Sustainable Development and Energy, Office of the organization of passenger road transport / VTC pole
Equipped with a registration badge affixed to the windshield of the vehicle. www.magic-vtc.fr undertakes to carry out or arrange for transport services in accordance with the booking form and in compliance with all applicable regulations and legislation.

In case of subcontracting, the company www.magic-vtc.fr ensures that the people and companies it uses meet the same conditions.

7 – RESPONSIBILITIES

www.magic-vtc.fr is guaranteed by a notoriously solvent insurance company that covers the risks related to its activity in accordance with the regulations in force.

In case of dispute, the responsibility of the company www.magic-vtc.fr can be retained only on the condition for the Customer to report the evidence of misconduct of the latter and a causal link with the damage claimed.

The companyʼs comprehensive multi-risk insurance policy www.magic-vtc.fr covers the responsibilities of the company.

The customer is responsible for his actions legally and criminally.
7 – 1 – RESPONSIBILITY OF CUSTOMER AND TRANSPORTED PERSONS

The customer agrees for himself and for the passengers for whom he has contracted with www.magic-vtc.fr to behave like a good father at the time of the assumption of responsibility, in particular, respecting the driver and the transport equipment and the following provisions:

Respect for the rules of the Highway Code (wearing of the safety belt, car seat, booster seat …),
Prohibition of smoking, eating and transporting hazardous materials. If necessary, your driver will make a stop on the trip.

Prohibition to consume alcohol in the vehicle,
Baggage is accepted and remains the responsibility of the customer. The company www.magic-vtc.fr can not be held responsible for damage and / or loss of luggage or electronic device (phone, tablet etc).
Any damage to the vehicle, because of the customer, will be entirely at his expense For all other degradations resulting in immobilization of the vehicle: – Billing in the real + Capital costs + Loss in revenue on an average of the last 3 months. In case of degradation resulting in a cancellation of the following service, a fixed price fixed rate of 450,00 € will be applied in addition, payable immediately by CB ..
The cleaning in case of vomit will be charged 450,00 € TTC in addition to the benefit payable immediately by CB.
Small pets are allowed, provided they are in a transport cage. Large assistance dogs are allowed.
Failure to comply with these provisions incurs the exclusive liability of the customer and passengers for both www.magic-vtc.fr and third parties.The company www.magic-vtc.fr/com declines all responsibility for the actions of his client before and after his transport. www.magic-vtc.fr/com  reserves the right to refuse the pick up, or to disembark, a passenger who does not respect these obligations, as well as an alcoholic passenger.

7 – 2 – CLAIMS

Any complaint is receivable only within 5 days of the execution of the transport service concerned. Any different falls within the Courts instead of the Head Office of the company Rejim Transport VTC

8 – PROVISION / TRANSFER 8 – 1 – TRANSFER:

The transfer service starts at the address of the company headquarters www.magic- vtc.fr/com  and ends when the customer arrives at the address provided.

8 – 2 – AVAILABILITY:
Provision: Transport is limited mileage in the framework of provision by the hour: 25 kilometers for 1 hour of availability,
125 kilometers for 5 hours of availability.
Any time started is due in full.
