A deposit will be taken in the event of a breach of the customer’s commitments as stipulated in the said contract, from then on a bank imprint will be made for the amount due by the customer registered on the first order form or the final order form.


The company REJIM TRANSPORT VTC TAXI as well as the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) reserve the right to charge an additional sum in the context of damage for compensation. This sum is fixed by the company REJIM TRANSPORT VTC TAXI. But the bank imprint made upstream is only a pledge deposit so as to guarantee you a driver for your pick-up and the commitment to the good repute of our services.


In case of late payment:
Every 45 days the invoice will be increased by 4.16% as provided for in Art L 441-6 of the Commercial Code.
And this excludes bailiff management fees and lawyers’ fees, disbursements and expenses.


The late payment rate for professionals is set freely by the merchant in accordance with the law.
Payments are cash. Cash payment: the customer has the obligation to pay for the goods or services on the day of delivery or performance.
The interest rate provided for by the T&Cs generally corresponds to the semi-annual key rate (refinancing or Refi rate) of the European Central Bank (ECB), in force on January 1 or July 1, plus 10 points.
Example: 10.00% (0.00 + 10) for penalties due since July 1, 2019. 5 –

RESERVATION AND CANCELLATION
5 – 1 – RESERVATION:


Any reservation implies the unreserved acceptance of these general conditions of sale.
The customer and the service provider undertake to respect all the clauses mentioned in this contract.
No modification may be made to the above conditions without prior agreement between the parties.
This contract would be suspended by the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©), the charges may be postponed or canceled as of right and without compensation (this includes in particular the reimbursement of the race) of any kind in all recognized cases of force majeure (event outside www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©)) such as disruption of traffic lanes, bad weather , demonstration, accident, breakdown or malfunction of telecommunications networks, shortage of labor or materials, etc.
The contract is not deemed concluded until the order is placed through the various communication tools delivered by the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©).

Special feature for station and airport pick-up:
• As soon as you arrive turn on your mobile phone.
• The driver reserves the right to postpone his pick-up according to the terms stipulated in the said contract.
• Please note in “additional information” when booking the flight or train number or any other information used to facilitate pick-up or to personalize your journeys (reception sign, concierge, musical playlist, still water, sparkling water , etc…).


For flights, if you do not have checked baggage in the hold, the 15-minute waiting time included in the fare is generally sufficient. However, if you need to retrieve checked baggage and/or if you are coming from a non-European destination, the time taken to leave the plane, the baggage claim and any checks by the police require quite long delays.
To avoid having to pay for a wait, we advise you to add a margin of 30 minutes for your pickup.


A 30-minute beat is granted to the driver from the time of taking charge of the order form.
For example: if your pick-up is set at 12:00 p.m., the actual pick-up will be between 12:00 p.m. and 12:30 p.m.

Payment on board is considered a commercial gesture and defers payment for the outward journey to the performance of the service. If the customer wishes to cancel the race, the latter will have to be liable for the full price of the estimate ofof the race.


For payments on board you will be asked for a guarantee (see article 3 of the said contract), this is a bank imprint which will guarantee the ability of a customer to pay the potentially payable costs stipulated in the said contract.


5 – 2 – CANCELLATION:
A reservation cannot be canceled by the customer.
Any amount advanced by the customer in cash, by check, by credit card or online payment is considered a deposit. If the customer refuses to complete the reservation or registration and decides to cancel the race, the sum will be lost in full under articles L21 4-1 to L214-4 of the consumer code.
If a customer orders and the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) could not honor a service in the context of force majeure (mentioned on the said contract), www.magic- vtc.fr/ www.magic-vtc.com (Magic VTC ©) may, as a gesture of goodwill, offer reimbursement of the trip in the form of a non-refundable credit note in the form of cash. A credit valid for an unlimited period of time. The platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) does not reimburse any amount advanced in the form of cash.
Payment on board is considered a commercial gesture and defers payment for the outward journey to the performance of the service. If the customer wishes to cancel the race, the latter will have to be liable for the full price of the service.
In the event that the customer refuses to pay his invoice or his order: the platform reserves the right to collect the amount of the deposit which will be equivalent to the amount of the price of the race as well as additional costs and compensation. The indemnities will be inspired by 50 to 100% of the price of the fine that the law provides for in the event of grivèlerie, 7000€, under the terms of article 313-5 of the Penal Code.


Any amount paid in advance on the sites www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and the AppStore and Playstore application (Magic VTC ©), or directly to an agent or manager, will be considered as a deposit whatever the means of payment used.


Reminder :
Article L214-1 to L214-4 of the consumer code which stipulates that:
The deposit is an amount paid in advance by a customer when making a purchase. The deposit entails a firm commitment by the seller and the buyer concerning:
– the obligation to buy for the consumer;
– and that of providing the goods for the merchant or the provision of services;
There is in principle no possibility of withdrawal, neither for you nor for the merchant. Consequence: If you refuse to perform the contract, you not only lose the deposit, but the merchant can also demand performance of the contract and claim damages from you in the event of default.
Failure to pay for a simple order is punishable by law. Harshness is prohibited in France.
The term used in the French penal code is “filouterie”. Under article 313-5 of the Penal Code.
It is an act that consists in ordering a service that one will refuse to pay for, or for which one is aware that one will not have the means to pay for it.
The offense is constituted if:
• the service has been ordered by the customer;
• the service has been consumed (meal started or finished, room occupied, taxi trip taken, fuel tank filled, etc.);
• the client is materially unable to settle his debt or is determined before consuming not to pay;
the fraudulent intention is recognized (this fraudulent intention must be prior to the consumption, the offense is not necessarily constituted, for example, if the consumer forgets to pay because he is busy on the phone, or leaves suddenly because of an event of force majeure or even because he disturbed by smoke or noise).
In common parlance, we speak of fraud for serious acts, and of free-riding for less serious acts.


Examples of trickery:
Leaving a restaurant, bar, hotel after being served, without paying the bill or bill;
get fuel and leave without paying.

Examples of free-riding:
Take the train without a ticket (variant: travel in first class with a second class ticket);
not paying the toll;
not paying for parking, parking;

5 – 3 – PRICE INCREASE / DELAY / CORK / TRAFFIC


All delay of the passenger(s), or any wait exceeding the time of the package indicated on our simulator www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and the AppStore application and Playstore (Magic VTC ©) or any deviation in addition to the Km indicated on our simulator or compared to the pick-up time indicated in the provisional or final booking form, results in an increase in the price of the service, in the event that in particular, the customer notifies the driver in advance by telephone on +33 4 69 96 49 00/+337 69 14 29 28/+33 6 51 14 114 11 for delays according to the following terms.


VTC:
• More than 15 minutes late: 10 euros
• More than 30 minutes late: 25 euros
• For any additional half-hour delay: 25 euros.
This amounts to 0.83 cents per minute, these prices also apply to heavy traffic or traffic jams or any type of deviation due to unforeseen events such as disruption of traffic lanes (works, etc.) bad weather, demonstrations, accidents, failure or malfunction of telecommunications networks. This price therefore applies in the form of traffic surcharges as stipulated in the said contract. It can either be observed by an agent, the driver or by means of a horokilometric counter on board the vehicle as permitted by the VTC regulations in force as well as the Thévenoud and Grand Guillaume laws.


TAXI:
Any waiting is charged at 0.51EUR per minute (TAXI) or 30.70EUR per hour. These prices also apply to heavy traffic or traffic jams or any type of deviation due to unforeseen events such as disruption of traffic routes (works, etc.), bad weather, demonstrations, accidents, breakdowns or malfunctions of telecommunication networks. This price therefore applies in the form of traffic surcharges as stipulated in the said contract. It can either be observed by an agent, the driver or by means of a horokilometric counter on board the vehicle as permitted by the TAXI regulations in force.

The payment of these increases occurs at the latest when the passenger(s) board the vehicle. Or at the end of the race.

In the event of the client’s absence at the meeting place, beyond the first 15 free minutes, without any manifestation on his part, or response to the driver’s phone call, or other means of communication such as WhatSapp, Viber, by Email, SMS, the service will be definitively lost, without the possibility of postponement and without being able to claim any refund.

 

6 – QUALITY OF SERVICE


Transporting people for a fee is a regulated activity.
Only authorized vehicles can perform this service and:
Provided with a professional card number issued by the prefecture.
Provided with a registration certificate issued by the Ministry of Ecology, Sustainable Development and Energy, Office for the organization of road passenger transport / VTC pole or ADS.
Provided with a registration badge affixed to the windshield of the vehicle. www.magic-vtc.fr/com undertakes to carry out or have carried out the transport services in accordance with the reservation form and in compliance with all regulations and legislation in force.
In the event of subcontracting, the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) of the company REJIM TRANSPORT VTC TAXI. Ensures that the people and companies it uses meet the same conditions.


7 – RESPONSIBILITIES
Www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) is guaranteed by a notoriously solvent insurance company which covers the risks related to its activity in accordance with the regulations in force.
In the event of a dispute, the responsibility of the company www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) can only be retained on the condition that the customer provides proof of faulty behavior on the part of the latter and of a causal link with the damage invoked.
The unlimited multi-risk insurance of the company www.magic-vtc.fr covers the liabilities related to the company.


The customer is legally and criminally responsible for his actions.


7 – 1 – RESPONSIBILITY OF THE CUSTOMER AND OF PERSONS TRANSPORTED
The customer undertakes for himself and for the passengers for whom he has contracted with www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) to behave like a good father from the start. load, in particular, respecting the driver and the transport equipment as well as the following provisions:
Compliance with the rules of the Highway Code (wearing a seat belt, car seat, booster seat, etc.).


Smoking, eating and transporting hazardous materials are prohibited.
If necessary, your driver will make a stop on the way.
Prohibition of the consumption of alcohol on board the vehicle.
Baggage is accepted and remains the responsibility of the customer.
The platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) of the company REJIM TRANSPORT VTC TAXI cannot be held responsible in the event of damage and/or loss of luggage or electronic device (telephone, tablet etc.).
Any damage to the vehicle, due to the customer, will be entirely at his expense.
For all other damage leading to immobilization of the vehicle: – Actual billing + Immobilization costs + Loss of revenue on an average of the last 3 months.
In the event of damage resulting in a yearcancellation of the following service, a fixed fee of €450.00 will be applied in addition, payable immediately by credit card, cash or check.


Cleaning in the event of vomit will be invoiced at €150.00 including tax in addition to the service payable immediately by credit card, plus the immobilization of the vehicle for €200.00, which will make a total sum in the event of damage of €350. €.00 payable immediately by credit card.
Pets, large or small, are accepted, provided they are in a transport cage.
Large assistance dogs are allowed. Transport with animal will be charged at 150€.


Failure to comply with these provisions engages the exclusive responsibility of the customer and passengers both with regard to www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and third parties.


The platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) of the company REJIM TRANSPORT VTC TAXI declines any responsibility concerning the actions of its customer before and after his transport. www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) reserves the right to refuse to take charge of, or disembark, a passenger who does not respect these obligations, as well as a passenger intoxicated or proof of verbal or physical aggression, in this context any sum advanced by the customer will be definitively lost.
These potentially payable costs are communicated to customers under the terms of consumption under the Consumer Code – Article L112-3.


7 – 2 – COMPLAINTS
Any claim is admissible only within 5 days of the execution of the transport service concerned. Any dispute is dealt with by the Courts instead of the Head Office of the company REJIM TRANSPORT VTC TAXI.


8 – PROVISION / TRANSFER 8 – 1 – TRANSFER:


The transfer service begins at the address of the headquarters of the company REJIM TRANSPORT VTC TAXI and ends upon the arrival of the customer at the planned address.


8 – 2 – PROVISION:


MAD provision: transport is limited in mileage within the framework of provision by the hour:
25 kilometers for 1 hour of availability,
125 kilometers for 5 hours of availability. Any hour started is due in full.
Our simulator informs you only about an estimate. An estimate must be drawn up for the provision (MAD) and the prices are not fixed.
